What these terms cover

These terms govern your use of this website and the free checklists, templates and guides we publish. By using the site you agree to them. If you do not agree, please do not use the site.

These terms are not our services agreement. If NexGen IT Solutions manages your IT, that relationship is governed by a separate signed agreement. Where the two differ, the signed agreement controls.

This site is not an offer

Descriptions of services, plans and inclusions on this site are for information. They are not a binding offer or a quote. Nothing here creates a client relationship. A relationship begins when both parties sign an agreement.

The free resources

Our checklists, worksheets and templates are educational. Please read this carefully:

They are not legal, compliance, insurance, tax or accounting advice, and using one does not create a professional relationship.
Completing a checklist does not make an organisation compliant with HIPAA, the FTC Safeguards Rule, IRS Publication 4557, PCI DSS, or any other framework. Several requirements under those frameworks are administrative and belong to your organisation.

This section describes our SMS program. It exists because mobile carriers require these disclosures to appear in the terms of service linked from any form that collects SMS consent, and because you are entitled to know what you are agreeing to.

SMS program description and messaging use cases

NexGen IT Solutions operates a conversational, non-marketing SMS program. If you opt in, we may send you messages for these use cases only:

Arranging, confirming, or rescheduling a fit call or appointment
Following up on a checklist, template, or other resource you requested
Responding to a question you asked us
Communicating with you about work in progress, including service or incident updates if you are a client

We do not send recurring promotional or marketing text campaigns, and message frequency varies based on your interaction with us.

Consent is optional

Agreeing to receive text messages is never required to request a resource, book a call, buy anything, or become a client. Consent is not a condition of any purchase.

Text STOP to any message at any time to opt out and cancel the SMS service. You may also reply STOP to unsubscribe. After you text STOP you will receive one confirmation message and then no further texts. You can also ask us to remove your number by emailing info@nexgenitsolutions.net or calling (810) 420-8737.

You must be 18+ to participate. You must be 18 years of age or older, and at least 18 years old, to consent to receive text messages from us and to use this website. This is a business service and is not directed at children.

Supported carriers

Our messaging is supported on major United States carriers. Carrier support can change and is not guaranteed.

Privacy

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Text messaging originator opt-in data and consent are not shared with any third party, except with subprocessors acting on our behalf strictly to deliver the messages you asked for. Acceptable use

Do not use this site to break the law, attempt to gain unauthorised access to it or to any connected system, scrape it at a rate that degrades service for others, submit false information or someone else's contact details without permission, or upload anything malicious.

Intellectual property

The content, design, copy, logos and downloadable materials on this site are owned by NexGen IT Solutions unless stated otherwise. You may link to us freely. Quote us with attribution. Do not copy substantial portions for commercial use without written permission.

Third-party links and tools

This site links to third-party sites and embeds third-party tools such as our booking calendar and forms. We do not control them and are not responsible for their content, availability, or privacy practices.

Availability

We aim to keep the site available, but we do not guarantee uninterrupted access. We may change, suspend or withdraw any part of it, including the free resources, at any time.

Disclaimer

To the fullest extent permitted by law, this website and its content are provided as is and as available, without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement.

Limitation of liability

To the fullest extent permitted by law, NexGen IT Solutions will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, lost data or business interruption, arising out of your use of this website or reliance on its free resources, even if we were advised such damages were possible.

Nothing in these terms limits liability that cannot lawfully be limited. This section does not affect the liability provisions of any signed services agreement between us.

Governing law

These terms are governed by the laws of the State of Michigan, without regard to conflict of law rules. Any dispute will be brought in the state or federal courts located in Michigan, and you consent to that jurisdiction.
